Terms of Service - Pocket Secretary (Telegram bot)

1. The service

Pocket Secretary (the "Bot") is run by FOP Ihor Aleksandrin, 70 Ispanska St., Kharkiv, 61205, Ukraine. It connects to your Telegram Business account and, in the private chats you choose, answers clients with texts you configured, collects requests, and (Pro) takes booking requests that you approve. It is a tool: you stay responsible for what is said in your chats and for your business.

2. Plans and payment

Free: one template, up to 20 requests per calendar month (UTC), up to 10 FAQ items.
Pro: price shown in /pro (currently 1 500 Telegram Stars for 30 days): unlimited requests and FAQ items, booking requests, CSV export, several templates. You can either subscribe (the subscription renews every 30 days until you stop it with /cancel or in Telegram; Pro then stays active until the end of the paid period) or pay once for 30 days. Pro runs for the purchased days; buying again adds days.
Payments are made in Telegram Stars through Telegram; we do not see your payment instrument. Digital services sold inside Telegram are paid in Stars as Telegram requires.
Refunds: contact us through /paysupport with your receipt id. If a refund is given, it is processed through Telegram and your Pro period is shortened by the refunded days. Statutory consumer rights are not affected. [Owner to confirm with a lawyer: handling of the EU right of withdrawal for digital services.]
When Pro ends, Free limits apply again; nothing is deleted. FAQ items beyond the Free limit stay saved but are not used.

3. Your responsibilities

You must be allowed to use Telegram Business and comply with Telegram's terms.
You decide what the Bot answers. Keep answers accurate, lawful and not misleading. Do not use the Bot for spam, harassment, or to collect sensitive data (for example health details) - ask clients to tell you personally instead.
You are the controller of your clients' data. Inform clients as the law requires; the Bot tells them it is an automated assistant.
Do not rely on the Bot for urgent or safety-critical messages.

4. Limits of the service

Telegram only lets a bot reply in a chat while the client's last message is less than 24 hours old, and only if you allow replies. The Bot cannot message clients outside that window; booking confirmations after it must be sent by you. Telegram can change these rules.
Working hours use a fixed UTC offset; daylight saving time changes are not automatic.
We aim for high availability but give no uptime guarantee. The Bot runs on third-party infrastructure (Telegram, Cloudflare).

5. Data

See the Privacy Policy. You can delete your data at any time with /deletedata.

6. Suspension and ending

You can stop at any time by removing the Bot in Telegram Settings > Business > Chatbots. We may suspend access for abuse, legal reasons or breach of these terms. Unused paid time is handled under section 2.

7. Liability

The Bot is provided "as is". To the extent the law allows, we are not liable for lost enquiries, missed bookings or indirect losses, and our total liability is limited to what you paid in the 3 months before the claim. Nothing limits liability that cannot be limited by law.

8. Changes and law

We may update these terms and will tell you in the Bot before material changes apply. The laws of Ukraine apply, subject to mandatory consumer protections in your country. Contact: support@dobriedela.com.
